Identification of the owner and purpose
These General Terms and Conditions of Contract expressly govern the commercial relationship between LEJAN BRAND, S.L, holder of tax identification number (CIF) B44612695, with registered office at Calle de Santa Engracia 151 2º - 1 (28003) Madrid, España, trading commercially under the brand LEJAN BRAND (hereinafter, LEJAN BRAND), and the users who purchase products through the website www.lejanbrand.com.
These terms and conditions apply to all purchases made through the aforementioned website and their purpose is to govern the rights and obligations of the parties within the framework of the electronic contracting of the products offered by LEJAN BRAND.
Applicable legal framework
These terms and conditions have been drawn up in accordance with the provisions of the legislation in force and, in particular, with:
- Law 34/2002, of 11 July, on information society services and electronic commerce (Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico, LSSI-CE).
- Law 7/1998, of 13 April, on General Contracting Conditions (Ley 7/1998, de 13 de abril, sobre Condiciones Generales de la Contratación).
- Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users (Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios), as currently in force.
- Law 7/1996, of 15 January, on Retail Trade Regulation (Ley 7/1996, de 15 de enero, de Ordenación del Comercio Minorista).
- Any other legislation that may be applicable.
Acceptance of the terms and conditions
Placing an order through the website entails the express and unreserved acceptance of these General Terms and Conditions by the user.
The user declares that they have read, understood and accepted these terms and conditions as a prior and indispensable step to completing the purchase.
Pre-contractual information
Through the website, the user may view all of the products offered by LEJAN BRAND, classified by category.
Each product has an individual product page providing clear and comprehensible information about its main characteristics, availability and price. Product descriptions are based on the information supplied by the manufacturers or suppliers.
LEJAN BRAND reserves the right to update, modify or withdraw products from the website without prior notice, while in all cases honouring orders already confirmed.
Prices, tax and shipping costs
All prices displayed on the website are expressed in euros and include Value Added Tax (VAT) or any other taxes that may be applicable.
Shipping costs are not included in the price of the product and will be shown itemised separately before the purchase process is completed.
Before confirming the order, the user will be able to view clearly and in detail the total price of the order, including taxes and, where applicable, shipping costs.
In the event of an obvious typographical error in the price of a product, LEJAN BRAND reserves the right to cancel the order, duly informing the user and refunding in full any amounts paid.
Non-substantial modifications to the product
The product purchased may undergo non-substantial modifications to its components, characteristics or features, provided that such modifications do not entail any impairment of the quality or of the features advertised.
Purchase process
The purchase process is carried out in accordance with the steps indicated on screen at each stage.
The user may add products to the shopping cart, review its contents and modify it before confirming the order. Once the selection of products has been completed, the user must click the “Checkout” button and provide the information requested, including delivery address, billing details, shipping method and means of payment.
Coupons and promotions
LEJAN BRAND may offer coupons or promotional codes as part of specific commercial campaigns. Such coupons will be subject to the specific conditions of each promotion and may only be used in accordance with the terms set out therein.
Newsletter and commercial communications
During the purchase process, the user may voluntarily subscribe to the LEJAN BRAND newsletter.
The subscription will be carried out solely by means of the user's express consent and in accordance with the provisions of the Privacy Policy, and the user may unsubscribe at any time through the means made available for that purpose.
Means of payment
Payment for orders may be made through the means of payment enabled on the website, such as credit or debit card, PayPal, bank transfer or any other means available at any given time.
Card payments are made through secure payment gateways managed by financial institutions, using encryption systems that guarantee the confidentiality of the data.
LEJAN BRAND does not store or have access to the complete details of the bank cards used by users.
Should a fraudulent or improper charge be detected, the user may demand the immediate cancellation of the charge in accordance with the applicable legislation.
Order confirmation and evidence of the contract
Once the purchase process has been completed, LEJAN BRAND will send the user a confirmation email including a summary of the order placed.
That email will constitute the acknowledgement of receipt of the contract and will serve as documentary evidence of the transaction, without prejudice to the user's right to request an invoice in accordance with the legislation in force.
Right of withdrawal, returns and warranties.
The conditions relating to the right of withdrawal, exchanges, returns, refunds, shipping and legal warranties are governed by the Shipping, Exchanges and Returns Policy, which forms an integral part of these General Terms and Conditions and is permanently accessible through the website.
Protection of personal data
The processing of the personal data provided by users within the framework of the contract is governed by the provisions of the Privacy Policy, permanently available on the website.
Use of cookies
The use of cookies and similar technologies is governed by the provisions of the Cookies Policy, accessible at all times from the website.
Applicable law and jurisdiction
These General Terms and Conditions are governed by Spanish law.
In the event of any dispute or conflict arising from the interpretation or performance of these terms and conditions, where the user has the status of a consumer, the parties shall submit to the Courts and Tribunals of the consumer's place of residence, in accordance with the legislation in force on the protection of consumers and users.
