CUSTOMER SERVICE	To process the personal data strictly necessary in order to handle or resolve the enquiry, request or petition made by the user.
MARKETING	To manage the sending of commercial communications, promotions or the Newsletter to all those users who have subscribed.
QUALITY SURVEYS	Sending quality surveys regarding the products or services provided.

 

LEGAL BASIS FOR THE PROCESSING

The user shall be responsible, in any event, for the truthfulness of the data provided. Otherwise, LEJAN BRAND may exclude the user from the services in respect of which false data has been provided, without prejudice to any other actions that may be legally available.

The legal basis that permits the processing of the personal data provided by the user shall be governed by the provisions set out below:

DATA RETENTION PERIOD

Personal data will be retained according to the purpose:

LEJAN BRAND informs users that it engages services with providers located outside the European Economic Area, guaranteeing in all cases an adequate level of protection by means of standard contractual clauses or other legally recognised mechanisms.

 

AUTOMATED DECISIONS AND PROFILING

LEJAN BRAND may carry out basic segmentation or profiling for commercial or statistical purposes (for example, product recommendations or the sending of personalised communications).

Under no circumstances are automated decisions taken that produce legal effects concerning the user or similarly significantly affect them, in accordance with Article 22 of the GDPR.

 

USERS' RIGHTS

Users who have provided personal data for LEJAN BRAND to process have the following rights:

RIGHT OF ACCESS	The user has the right to obtain from LEJAN BRAND confirmation as to whether or not personal data concerning them is being processed, as well as to access the personal data held by LEJAN BRAND.
RIGHT TO RECTIFICATION	The user has the right to request that LEJAN BRAND rectify inaccurate data concerning them. They shall also have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
RIGHT TO ERASURE/RIGHT TO BE FORGOTTEN	The user shall have the right to have LEJAN BRAND erase the personal data concerning them, always taking into account the requirements established in the legislation in force.
RIGHT TO RESTRICTION	The user shall have the right to request that LEJAN BRAND restrict the processing of their personal data, always taking into account the requirements established in the legislation in force.
RIGHT TO DATA PORTABILITY	The user shall have the right to receive from LEJAN BRAND the personal data concerning them in a structured, commonly used and machine-readable format, and to transmit it to another controller where the processing is based on consent or on a contract and is carried out by automated means.
RIGHT TO OBJECT	The user has the right to object to LEJAN BRAND processing the personal data concerning them where such data is subject to processing based on public or legitimate interest. In such a case, LEJAN BRAND shall cease to process the data, unless there are compelling legitimate grounds or for the establishment, exercise or defence of legal claims.
RIGHT TO LODGE A COMPLAINT	The user has the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos) if they consider that the rights set out above in this privacy policy are being infringed or if they consider that the processing of personal data concerning them infringes Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights.

 

The user may exercise the rights described above by sending a written communication to the address: Calle Santa Engracia 151, 2º-1, Madrid (28003) or alternatively by email to hola@lejanbrand.com, in both cases enclosing a photocopy of their DNI (national identity document) or another similar identification document and with the subject line “PROTECCIÓN DE DATOS – LEJAN BRAND”.

 

DATA PROTECTION OFFICER

LEJAN BRAND is not legally required to appoint a Data Protection Officer (DPO), in accordance with the legislation in force and the nature of the processing carried out.

 

SOCIAL MEDIA

LEJAN BRAND is present on the main social networks: Instagram, TikTok, YouTube and LinkedIn. For this reason, it assumes the role of Data Controller in respect of the data submitted on its profiles arising from friends, likes, followers, comments, pins, etc.

The user expressly agrees to be bound by the conditions and terms which, in matters of privacy, are laid down by the various social networks or platforms where LEJAN BRAND is present, authorising the latter to use the means that those same networks allow in order to inform users about the different activities and services that it carries out.

 

MINORS.

Children under 14 years of age may not use the services available on this website without the prior authorisation of their parents, guardians or legal representatives, who shall be solely responsible for all acts carried out through this website by the minors in their care, including the completion of forms with the personal data of such minors and the ticking, where applicable, of the boxes accompanying them.

In this regard, and insofar as LEJAN BRAND is not able to verify whether or not users are minors, it shall be for the parents, guardians or legal representatives to put in place the necessary mechanisms to prevent minors from accessing this website and/or providing personal data without their supervision, LEJAN BRAND accepting no liability whatsoever in this respect.

 

DATA SECURITY AND SECURITY BREACHES

In order to guarantee the security and integrity of the personal data provided, LEJAN BRAND has adopted the technical and organisational measures necessary to prevent the loss of the data, as well as its unauthorised processing or access by third parties, as stipulated by the legislation in force on this matter and taking into account the state of the art and the nature of the data stored.

 

CHANGES TO THE PRIVACY POLICY

This Privacy Policy may be updated at any time on the basis of the website's own needs and future legislative changes in the field of privacy, LEJAN BRAND reserving this right exclusively.

Should such a modification be made, LEJAN BRAND will inform the user of the changes in question if they are significant for their privacy, so that the changes introduced may be reviewed in order to assess whether to object to the processing of personal data or to unsubscribe from any service or functionality. In any event, if consent is required for the processing of personal data for purposes other than those provided for in this privacy policy, the user's consent will be requested in accordance with the provisions of the data protection legislation in force at any given time.
